Algemene Voorwaarden Bigtwin Bikeshow & Expo

Deze algemene voorwaarden zijn van toepassing op de Bigtwin Bikeshow & Expo, hierna te noemen: “het Evenement”.
Het Evenement wordt georganiseerd door:
Motor.NL Media Company, een handelsnaam van Pite Media B.V.

Door het kopen van een toegangsbewijs, betreden van het Evenement, inschrijven voor de Custom Bike Show of aanmelden als exposant of standhouder, gaat de betreffende persoon of organisatie akkoord met deze algemene voorwaarden voor zover deze op hem of haar van toepassing zijn.
Artikel 1 | Definities
In deze algemene voorwaarden wordt verstaan onder:
Organisator: Pite Media B.V., handelend onder de naam Motor.NL Media Company.
Evenement: de Bigtwin Bikeshow & Expo en alle activiteiten die daarvan onderdeel uitmaken.
Bezoeker: iedere persoon die het Evenement bezoekt.
Deelnemer: iedere persoon of organisatie die een motor inschrijft voor deelname aan de Custom Bike Show of een andere wedstrijd of presentatie die onderdeel uitmaakt van het Evenement.
Exposant: iedere onderneming, organisatie of persoon die met een stand, kraam, unit, verkoopplaats, presentatie of andere commerciële of promotionele activiteit aan het Evenement deelneemt.
Locatie: het gebouw, terrein en de bijbehorende voorzieningen waar het Evenement plaatsvindt.
Artikel 2 | Toepasselijkheid
2.1 Deze algemene voorwaarden zijn van toepassing op alle overeenkomsten, inschrijvingen, toegangsbewijzen en andere afspraken tussen de Organisator en Bezoekers, Deelnemers en Exposanten.
2.2 Aanvullende voorwaarden, huisregels of praktische voorschriften kunnen van toepassing zijn op specifieke onderdelen van het Evenement. Deelnemers en Exposanten zijn verplicht deze voorschriften op te volgen.
2.3 Wanneer aanvullende voorwaarden specifiek betrekking hebben op een bepaald onderdeel van het Evenement, gelden deze aanvullend op deze algemene voorwaarden.
2.4 De meest actuele versie van deze algemene voorwaarden wordt gepubliceerd op bigtwinbikeshow.com.
BEZOEKERS
Artikel 3 | Toegang tot het Evenement
3.1 Toegang tot het Evenement is uitsluitend mogelijk met een geldig toegangsbewijs, uitnodiging, accreditatie, polsbandje of ander door de Organisator erkend toegangsbewijs.
3.2 Een toegangsbewijs geeft uitsluitend recht op toegang op de daarop aangegeven dag of dagen en tijdens de daarvoor geldende openingstijden.
3.3 De Organisator kan een Bezoeker de toegang weigeren of van het terrein verwijderen wanneer deze zich niet aan de huisregels houdt, overlast veroorzaakt, de veiligheid in gevaar brengt of aanwijzingen van de Organisator, medewerkers van de Locatie, beveiliging of hulpdiensten niet opvolgt.
3.4 In een dergelijk geval bestaat geen recht op restitutie van het toegangsbewijs.
Artikel 4 | Veiligheid en gedrag
4.1 Bezoekers dienen aanwijzingen van de Organisator, medewerkers van de Locatie, beveiligingspersoneel, brandweer en andere hulpdiensten te allen tijde op te volgen.
4.2 Het is niet toegestaan gevaarlijke, verboden of anderszins door de Organisator of Locatie ongewenst geachte voorwerpen mee te nemen naar het Evenement.
4.3 De Organisator kan om veiligheidsredenen controles uitvoeren of laten uitvoeren voor zover dit wettelijk is toegestaan.
4.4 Het is niet toegestaan zonder toestemming activiteiten te verrichten die de veiligheid, orde, bedrijfsvoering of het plezier van andere aanwezigen kunnen verstoren.
Artikel 5 | Eigen risico en aansprakelijkheid
5.1 Het bezoeken van het Evenement geschiedt voor eigen risico.
5.2 De Organisator is niet aansprakelijk voor verlies, diefstal, beschadiging of vermissing van persoonlijke eigendommen, tenzij de schade het rechtstreekse gevolg is van een aan de Organisator toerekenbare tekortkoming en aansprakelijkheid volgens dwingend recht niet kan worden uitgesloten.
5.3 De Organisator is niet aansprakelijk voor indirecte schade, gevolgschade of schade als gevolg van handelen van andere Bezoekers, Deelnemers, Exposanten of derden, voor zover uitsluiting daarvan wettelijk is toegestaan.
5.4 Niets in deze voorwaarden beperkt aansprakelijkheid die volgens de wet niet mag worden uitgesloten of beperkt.
CUSTOM BIKE SHOW
Artikel 6 | Inschrijving
6.1 Een motor kan voor de Custom Bike Show worden aangemeld via de door de Organisator aangegeven inschrijfmethode.
6.2 De Deelnemer is verantwoordelijk voor het volledig en naar waarheid verstrekken van de gevraagde informatie.
6.3 Een inschrijving geeft niet automatisch recht op deelname. De Organisator kan bepalen dat een inschrijving niet in behandeling wordt genomen of deelname weigeren, onder meer vanwege beschikbare ruimte, klasse-indeling, kwaliteit, veiligheid of geschiktheid voor de Bikeshow.
6.4 Indien voor deelname reeds een bedrag is betaald en de Organisator besluit de inschrijving niet te accepteren, wordt dit bedrag gerestitueerd.
6.5 De Organisator bepaalt in welke klasse of categorie een motor wordt ingedeeld en kan een inschrijving indien nodig in een andere klasse plaatsen.
6.6 De Deelnemer verklaart bevoegd te zijn om de betreffende motor in te schrijven en, indien van toepassing, toestemming te hebben van de eigenaar.
Artikel 7 | Motoren en presentatie
7.1 Deelnemers zijn zelf verantwoordelijk voor het transport van hun motor naar en van het Evenement.
7.2 Deelnemers dienen zich te houden aan de instructies van de Organisator en Locatie met betrekking tot aankomst, opbouw, plaatsing, brandstof, accu’s, veiligheid en vertrek.
7.3 Een motor mag tijdens het Evenement niet zonder toestemming van de Organisator worden verplaatst of verwijderd.
7.4 De Organisator kan aanvullende veiligheidsmaatregelen voorschrijven, waaronder maatregelen met betrekking tot brandstof, accu’s, vloeistoffen of andere onderdelen die in een tentoonstellingsruimte een veiligheidsrisico kunnen vormen.
7.5 De Organisator mag een motor weigeren of laten verwijderen wanneer deze naar het oordeel van de Organisator of de Locatie een veiligheidsrisico vormt.
Artikel 8 | Aansprakelijkheid en verzekering deelnemende motoren
8.1 Deelname aan de Custom Bike Show geschiedt voor eigen risico.
8.2 De Deelnemer is zelf verantwoordelijk voor een passende verzekering tegen onder andere wettelijke aansprakelijkheid, schade, brand, verlies, diefstal en vermissing.
8.3 De Organisator is niet aansprakelijk voor schade aan, diefstal van of vermissing van een deelnemende motor of daarbij behorende onderdelen en eigendommen, tenzij aansprakelijkheid volgens dwingend recht niet kan worden uitgesloten.
8.4 De Deelnemer is aansprakelijk voor schade die door hemzelf, personen die namens hem handelen of zijn inzending wordt veroorzaakt aan de Organisator, de Locatie of derden.
8.5 De Deelnemer vrijwaart de Organisator, voor zover wettelijk toegestaan, tegen aanspraken van derden die voortvloeien uit handelen of nalaten van de Deelnemer, personen die namens hem handelen of uit de door hem ingebrachte motor of andere eigendommen.
Artikel 9 | Jurering en prijzen
9.1 De Organisator bepaalt de wijze waarop de Custom Bike Show wordt gejureerd en stelt de jury samen.
9.2 Beslissingen van de jury zijn definitief, behoudens een aantoonbare administratieve of technische fout.
9.3 Over de uitslag kan niet worden gecorrespondeerd.
9.4 Prijzen zijn persoonlijk en kunnen niet worden ingewisseld voor geld, tenzij uitdrukkelijk anders is aangegeven.
9.5 Wanneer een prijs door een derde partij beschikbaar wordt gesteld, kunnen aanvullende voorwaarden van deze partij van toepassing zijn.
EXPOSANTEN EN STANDHOUDERS
Artikel 10 | Aanmelding en deelname
10.1 Een aanvraag voor deelname als Exposant is pas definitief nadat deze door de Organisator is bevestigd.
10.2 De Organisator kan naar eigen beoordeling besluiten een aanvraag niet in behandeling te nemen of deelname te weigeren wanneer de aangeboden producten, diensten, presentatie of activiteit niet passen binnen de aard of opzet van het Evenement.
10.3 Indien de Organisator een inschrijving weigert nadat reeds standhuur is betaald, wordt de betaalde standhuur gerestitueerd.
10.4 De Organisator bepaalt de indeling van de beursvloer en kan een eerder aangegeven standplaats wijzigen wanneer dit voor de organisatie, veiligheid of inrichting van het Evenement noodzakelijk is.
10.5 Onderverhuur, overdracht of het geheel of gedeeltelijk laten gebruiken van een stand door derden is uitsluitend toegestaan na voorafgaande toestemming van de Organisator.
Artikel 11 | Betaling
11.1 De volledige factuur voor deelname dient uiterlijk veertien dagen vóór de opening van het Evenement te zijn voldaan, tenzij schriftelijk anders is overeengekomen.
11.2 Indien de factuur niet tijdig is voldaan, vervalt iedere aanspraak op de gereserveerde standplaats.
11.3 Het vervallen van de standplaats wegens niet-tijdige betaling ontslaat de Exposant niet van zijn betalingsverplichting. De Organisator is gerechtigd het volledige verschuldigde inschrijfgeld te innen.
11.4 Eventuele belastingen en heffingen worden in rekening gebracht voor zover van toepassing.
Artikel 12 | Annulering door de Exposant
12.1 Annulering dient schriftelijk of per e-mail aan de Organisator te worden doorgegeven.
12.2 Bij annulering van een reeds gereserveerde stand, unit of kraam gelden de volgende annuleringskosten:
- bij annulering vier weken voorafgaand aan het Evenement: 25% van het factuurbedrag voor de gereserveerde vierkante meters;
- bij annulering drie weken voorafgaand aan het Evenement: 50% van het factuurbedrag voor de gereserveerde vierkante meters;
- bij annulering twee weken voorafgaand aan het Evenement: 75% van het factuurbedrag voor de gereserveerde vierkante meters;
- bij annulering één week voorafgaand aan het Evenement of later: 100% van het totale factuurbedrag, inclusief gereserveerde facilitaire voorzieningen.
12.3 Bij de annuleringspercentages van 25%, 50% en 75% worden facilitaire voorzieningen niet meegenomen in de berekening, tenzij deze voorzieningen reeds door de Organisator zijn besteld of kosten hiervoor reeds zijn gemaakt.
12.4 Annulering ontslaat de Exposant niet van de verplichting de op grond van dit artikel verschuldigde bedragen te voldoen.
Artikel 13 | Aanwezigheid en gebruik van de stand
13.1 De Exposant dient gedurende de voor bezoekers geldende openingstijden aanwezig te zijn en de stand geopend en representatief te houden.
13.2 Het voortijdig geheel of gedeeltelijk afbreken of ontruimen van de stand tijdens openingstijden is niet toegestaan zonder toestemming van de Organisator.
13.3 De Exposant dient aanwijzingen van de Organisator, de directie van de Locatie, brandweer, beveiliging en andere bevoegde instanties op te volgen. Dit geldt in het bijzonder voor veiligheidsmaatregelen tijdens het Evenement.
13.4 Op het Evenement mogen uitsluitend goederen en diensten worden aangeboden die passen binnen de aard en opzet van het Evenement, een en ander ter beoordeling van de Organisator.
13.5 De Exposant is zelf verantwoordelijk om vooraf bij de Organisator na te gaan of zijn voorgenomen producten, diensten of activiteiten zijn toegestaan.
Artikel 14 | Standinrichting, reclame en overlast
14.1 De inrichting en het gebruik van de stand, de verkoop van goederen en het aanbieden van diensten mogen geen hinder, gevaar of overlast voor andere aanwezigen veroorzaken.
14.2 Het is zonder voorafgaande toestemming van de Organisator niet toegestaan buiten de eigen stand reclame-uitingen, folders, promotiematerialen of andere commerciële uitingen op te hangen, neer te zetten of uit te delen.
14.3 Voor het gebruik van geluidsversterking is voorafgaande toestemming van de Organisator vereist.
14.4 Een verleende toestemming voor geluidsversterking kan op ieder moment worden ingetrokken wanneer naar het oordeel van de Organisator sprake is van overlast of onjuist gebruik.
14.5 Activiteiten waarbij sprake is van rook, vuur, bijzondere elektrische belasting of andere mogelijke veiligheidsrisico’s zijn uitsluitend toegestaan na voorafgaande toestemming van de Organisator en/of de Locatie.
Artikel 15 | Stand, locatie en materialen
15.1 De Exposant is verantwoordelijk voor een veilige en deugdelijke inrichting en het gebruik van zijn stand.
15.2 Vluchtwegen, nooduitgangen, brandblusmiddelen en andere veiligheidsvoorzieningen moeten te allen tijde vrij toegankelijk blijven.
15.3 Het is niet toegestaan vloeren, wanden, plafonds of andere onderdelen van de Locatie te beschadigen. Hieronder valt onder andere boren, spijkeren, schroeven, schilderen, behangen, plakken of andere werkzaamheden die blijvende schade kunnen veroorzaken, tenzij daarvoor vooraf toestemming is verleend.
15.4 Schade aan de Locatie, stands, kramen, dekzeilen, klemmen, materialen of andere door de Organisator of Locatie ter beschikking gestelde zaken wordt aan de Exposant doorberekend wanneer deze schade aan hem kan worden toegerekend.
15.5 De Exposant dient de stand gedurende het Evenement schoon en ordelijk te houden.
15.6 Na afloop dient de stand volledig ontruimd en schoon te worden achtergelaten binnen de door de Organisator aangegeven afbouwtijd.
15.7 Kosten voor schoonmaak, herstel, verwijdering van achtergelaten goederen of afval en andere kosten die ontstaan doordat de Exposant niet aan deze verplichtingen voldoet, kunnen op basis van nacalculatie aan de Exposant worden doorberekend.
Artikel 16 | Stroom, verlichting en standopbouw
16.1 Elektriciteit is uitsluitend beschikbaar indien hiervoor vooraf een aansluiting is gereserveerd of wanneer hierover andere afspraken met de Organisator zijn gemaakt.
16.2 De Exposant is verantwoordelijk voor voldoende en deugdelijke verlichting van de eigen stand en voor het gebruik van veilige en goedgekeurde elektrische apparatuur.
16.3 Bij bijzondere standbouw, grote constructies of het gebruik van vrachtwagens of andere grote voertuigen voor op- of afbouw dient de Exposant dit vooraf aan de Organisator te melden.
16.4 De Organisator kan verlangen dat de Exposant vooraf informatie verstrekt over onder andere de hoogte en afmetingen van de stand en de afmetingen en hoogte van voertuigen die voor de opbouw worden gebruikt.
16.5 De Exposant dient zich te houden aan de door de Organisator vastgestelde op- en afbouwtijden.
Artikel 17 | Verkoop en alcohol
17.1 Wanneer verkoop tijdens het Evenement is toegestaan, is de Exposant zelf verantwoordelijk voor naleving van alle toepasselijke wettelijke regels met betrekking tot verkoop, consumentenrechten, productveiligheid, belastingen en betalingen.
17.2 De Organisator is geen partij bij overeenkomsten tussen Exposanten en Bezoekers en is niet aansprakelijk voor producten of diensten die door Exposanten worden aangeboden of verkocht.
17.3 Het is Exposanten niet toegestaan alcoholhoudende dranken te verkopen vanuit de stand, tenzij daarvoor vooraf uitdrukkelijke toestemming is verleend door de Organisator en de verkoop volledig in overeenstemming met de toepasselijke wet- en regelgeving plaatsvindt.
17.4 Boetes, schade en overige kosten die voortvloeien uit een overtreding door de Exposant van de toepasselijke regels omtrent alcohol zijn voor rekening van de Exposant.
Artikel 18 | Aansprakelijkheid en verzekering Exposanten
18.1 De Exposant neemt deel voor eigen rekening en risico en dient zelf zorg te dragen voor passende verzekeringen tegen onder andere wettelijke aansprakelijkheid, schade, brand, verlies en diefstal.
18.2 De Organisator is niet aansprakelijk voor verlies, diefstal of beschadiging van goederen, standmaterialen, voertuigen of andere eigendommen van de Exposant, tenzij aansprakelijkheid volgens dwingend recht niet kan worden uitgesloten.
18.3 De Exposant is aansprakelijk voor schade die door hemzelf, zijn personeel, hulppersonen, stand, materialen, producten, diensten of activiteiten wordt veroorzaakt aan de Organisator, de Locatie of derden.
18.4 De Exposant vrijwaart de Organisator, voor zover wettelijk toegestaan, tegen aanspraken van derden die voortvloeien uit handelen of nalaten van de Exposant, zijn personeel of hulppersonen of verband houden met zijn producten, diensten, stand of activiteiten.
ALGEMENE BEPALINGEN
Artikel 19 | Foto, video en media
19.1 Tijdens het Evenement kunnen foto’s, video- en geluidsopnamen worden gemaakt voor journalistieke, promotionele, commerciële en archiefdoeleinden rond de Bigtwin Bikeshow & Expo en de activiteiten van de Organisator.
19.2 Bezoekers kunnen als onderdeel van algemene sfeerbeelden herkenbaar in beeld komen. Voor gerichte portretten of ander gebruik waarbij toestemming volgens de toepasselijke wetgeving noodzakelijk is, houdt de Organisator rekening met de daarvoor geldende regels.
19.3 Deelnemers en Exposanten begrijpen dat hun motoren, stands, producten en presentaties onderdeel vormen van het Evenement en daarom kunnen worden gefotografeerd en gefilmd en kunnen verschijnen in redactionele en promotionele uitingen over het Evenement.
19.4 Professionele of commerciële foto-, video- of geluidsopnamen door derden zijn uitsluitend toegestaan met toestemming van de Organisator.
Artikel 20 | Programma en wijzigingen
20.1 De Organisator kan het programma, de openingstijden, indeling, activiteiten, deelnemers, artiesten, presentaties of andere onderdelen van het Evenement wijzigen wanneer omstandigheden daartoe aanleiding geven.
20.2 Dergelijke wijzigingen geven niet automatisch recht op restitutie of schadevergoeding.
20.3 Indien bijzondere omstandigheden dit noodzakelijk maken, kan de Organisator aanvullende eisen stellen aan Bezoekers, Deelnemers en Exposanten met betrekking tot toegang, veiligheid, gezondheid, inrichting of gebruik van de Locatie.
Artikel 21 | Verplaatsing, annulering en overmacht
21.1 De Organisator behoudt zich het recht voor om wegens bijzondere omstandigheden die buiten zijn redelijke invloed liggen de vastgestelde data van het Evenement te wijzigen, het Evenement te verplaatsen, te onderbreken of geen doorgang te laten vinden.
21.2 Hieronder vallen onder meer overheidsmaatregelen, brand, extreme weersomstandigheden, uitval van essentiële voorzieningen, stakingen, epidemieën, pandemieën, ernstige veiligheidsrisico’s, terrorisme, oorlog en andere omstandigheden waardoor het Evenement redelijkerwijs niet of niet veilig kan plaatsvinden.
21.3 Wanneer het Evenement wordt verplaatst naar een andere datum, blijft een met een Exposant of Deelnemer gesloten overeenkomst in beginsel van kracht voor de nieuwe datum.
21.4 Wanneer het Evenement definitief door de Organisator wordt geannuleerd wegens omstandigheden als bedoeld in dit artikel, vervalt de overeenkomst tot deelname.
21.5 Bij definitieve annulering wordt reeds betaalde standhuur gerestitueerd of gecrediteerd. De Organisator is niet gehouden tot een hogere vergoeding dan het door de betreffende Exposant betaalde bedrag, onder aftrek van eventuele specifieke kosten die op uitdrukkelijke opdracht van de Exposant reeds door de Organisator zijn gemaakt, voor zover een dergelijke aftrek wettelijk is toegestaan.
21.6 Indien het Evenement verplicht wordt geannuleerd als gevolg van maatregelen van de overheid, wordt de factuur voor deelname als Exposant volledig gecrediteerd.
21.7 De Organisator is bij verplaatsing of annulering niet aansprakelijk voor bijkomende schade of kosten van Bezoekers, Deelnemers of Exposanten, zoals reis-, verblijf-, transport-, personeels-, productie- of andere gevolgkosten, voor zover uitsluiting daarvan wettelijk is toegestaan.
21.8 Voor toegangsbewijzen van consumenten gelden bij annulering of verplaatsing de toepasselijke dwingendrechtelijke consumentenregels.
Artikel 22 | Intellectuele eigendom
22.1 Namen, logo’s, beeldmerken, ontwerpen, teksten en andere materialen van de Bigtwin Bikeshow & Expo mogen niet zonder voorafgaande toestemming van de rechthebbende voor commerciële doeleinden worden gebruikt.
22.2 Deelnemers en Exposanten blijven verantwoordelijk voor materiaal dat zij zelf aanleveren en verklaren dat het gebruik daarvan geen inbreuk maakt op rechten van derden.
22.3 Door foto’s, teksten, logo’s of ander materiaal voor publicatie rondom het Evenement aan te leveren, verleent de betreffende Deelnemer of Exposant de Organisator toestemming om dit materiaal te gebruiken voor communicatie, promotie, verslaggeving en archivering van het Evenement, tenzij schriftelijk anders is overeengekomen.
Artikel 23 | Persoonsgegevens
23.1 De Organisator verwerkt persoonsgegevens in overeenstemming met de toepasselijke privacywetgeving.
23.2 Meer informatie over de verwerking van persoonsgegevens is opgenomen in de Privacyverklaring op bigtwinbikeshow.com.
Artikel 24 | Toepasselijk recht
24.1 Op deze algemene voorwaarden en alle overeenkomsten met betrekking tot de Bigtwin Bikeshow & Expo is Nederlands recht van toepassing.
24.2 Geschillen worden voorgelegd aan de bevoegde Nederlandse rechter, tenzij dwingend recht een andere bevoegde rechter voorschrijft.
Artikel 25 | Slotbepalingen
25.1 Wanneer een bepaling uit deze algemene voorwaarden geheel of gedeeltelijk ongeldig of niet-afdwingbaar blijkt te zijn, blijven de overige bepalingen onverminderd van kracht.
25.2 In situaties waarin deze algemene voorwaarden niet voorzien, beslist de Organisator met inachtneming van de redelijkheid, toepasselijke wetgeving en de belangen van de betrokken partijen.

By purchasing an admission ticket, entering the Event, registering for the Custom Bike Show or applying to participate as an exhibitor or stand holder, the relevant person or organisation agrees to these Terms & Conditions insofar as they apply to them.
Article 1 | Definitions
For the purposes of these Terms & Conditions, the following definitions apply:
Organiser: Pite Media B.V., trading as Motor.NL Media Company.
Event: the Bigtwin Bikeshow & Expo and all activities forming part of it.
Visitor: any person visiting the Event.
Participant: any person or organisation registering a motorcycle for participation in the Custom Bike Show or any other competition or presentation forming part of the Event.
Exhibitor: any company, organisation or person participating in the Event with a stand, market stall, unit, sales area, presentation or other commercial or promotional activity.
Venue: the building, grounds and associated facilities where the Event takes place.
Article 2 | Applicability
2.1 These Terms & Conditions apply to all agreements, registrations, admission tickets and other arrangements between the Organiser and Visitors, Participants and Exhibitors.
2.2 Additional terms, house rules or practical instructions may apply to specific parts of the Event. Participants and Exhibitors are required to comply with these instructions.
2.3 Where additional conditions specifically relate to a certain part of the Event, those conditions apply in addition to these Terms & Conditions.

VISITORS
Article 3 | Admission to the Event
3.1 Admission to the Event is only permitted with a valid admission ticket, invitation, accreditation, wristband or other form of admission recognised by the Organiser.
3.2 An admission ticket only entitles the holder to admission on the day or days stated on the ticket and during the applicable opening hours.
3.3 The Organiser may refuse admission to a Visitor or remove a Visitor from the Event if the Visitor fails to comply with the house rules, causes a nuisance, endangers safety or fails to follow instructions from the Organiser, Venue staff, security personnel or emergency services.
3.4 In such cases, the Visitor shall not be entitled to a refund of the admission ticket.
Article 4 | Safety and Conduct
4.1 Visitors must at all times follow instructions given by the Organiser, Venue staff, security personnel, the fire service and other emergency services.
4.2 It is not permitted to bring dangerous, prohibited or otherwise undesirable items, as determined by the Organiser or Venue, into the Event.
4.3 For safety reasons, the Organiser may carry out or arrange inspections insofar as permitted by law.
4.4 Activities that may disrupt safety, public order, business operations or the enjoyment of other attendees are not permitted without prior permission.
Article 5 | Own Risk and Liability
5.1 Visitors attend the Event at their own risk.
5.2 The Organiser shall not be liable for loss, theft, damage to or disappearance of personal property unless the damage is the direct result of a breach attributable to the Organiser and liability cannot be excluded under mandatory law.
5.3 The Organiser shall not be liable for indirect damage, consequential damage or damage resulting from the actions of other Visitors, Participants, Exhibitors or third parties, insofar as such exclusion is permitted by law.
5.4 Nothing in these Terms & Conditions limits any liability that cannot legally be excluded or restricted.
CUSTOM BIKE SHOW
Article 6 | Registration
6.1 A motorcycle may be registered for the Custom Bike Show using the registration method specified by the Organiser.
6.2 The Participant is responsible for providing all requested information fully and truthfully.
6.3 Registration does not automatically entitle the Participant to take part. The Organiser may decide not to process a registration or may refuse participation, including on the basis of available space, class allocation, quality, safety or suitability for the Bikeshow.
6.4 If a participation fee has already been paid and the Organiser decides not to accept the registration, this amount will be refunded.
6.5 The Organiser determines the class or category in which a motorcycle will compete and may, where necessary, move an entry to another class.
6.6 The Participant declares that they are authorised to register the motorcycle concerned and, where applicable, have obtained permission from its owner.
Article 7 | Motorcycles and Presentation
7.1 Participants are responsible for transporting their motorcycles to and from the Event.
7.2 Participants must comply with the instructions of the Organiser and Venue regarding arrival, setup, positioning, fuel, batteries, safety and departure.
7.3 A motorcycle may not be moved or removed during the Event without the Organiser’s permission.
7.4 The Organiser may impose additional safety measures, including measures relating to fuel, batteries, fluids or other components that may present a safety risk within an exhibition space.
7.5 The Organiser may refuse or require the removal of a motorcycle if, in the opinion of the Organiser or the Venue, it presents a safety risk.
Article 8 | Liability and Insurance for Participating Motorcycles
8.1 Participation in the Custom Bike Show is at the Participant’s own risk.
8.2 The Participant is responsible for obtaining appropriate insurance against, among other things, legal liability, damage, fire, loss, theft and disappearance.
8.3 The Organiser shall not be liable for damage to, theft of or loss of a participating motorcycle or associated parts and property, unless liability cannot be excluded under mandatory law.
8.4 The Participant shall be liable for any damage caused by the Participant, persons acting on their behalf or their entry to the Organiser, the Venue or third parties.
8.5 The Participant shall indemnify the Organiser, insofar as permitted by law, against claims from third parties arising from acts or omissions by the Participant, persons acting on their behalf, or from the motorcycle or other property brought to the Event by the Participant.
Article 9 | Judging and Prizes
9.1 The Organiser determines how the Custom Bike Show is judged and appoints the jury.
9.2 Decisions of the jury are final, except in the event of a demonstrable administrative or technical error.
9.3 No correspondence will be entered into regarding the results.
9.4 Prizes are personal and cannot be exchanged for cash unless expressly stated otherwise.
9.5 Where a prize is provided by a third party, additional terms and conditions imposed by that party may apply.
EXHIBITORS AND STAND HOLDERS
Article 10 | Application and Participation
10.1 An application to participate as an Exhibitor shall only become final once it has been confirmed by the Organiser.
10.2 The Organiser may, at its own discretion, decide not to process an application or refuse participation if the products, services, presentation or activity offered do not fit the nature or concept of the Event.
10.3 If the Organiser refuses an application after stand rental has already been paid, the paid stand rental will be refunded.
10.4 The Organiser determines the layout of the exhibition floor and may change a previously indicated stand location where necessary for the organisation, safety or layout of the Event.
10.5 Subletting, transfer or allowing a stand to be used, in whole or in part, by third parties is only permitted with the Organiser’s prior approval.
Article 11 | Payment
11.1 The full invoice for participation must be paid no later than fourteen days before the opening of the Event, unless otherwise agreed in writing.
11.2 If the invoice is not paid on time, any entitlement to the reserved stand location shall lapse.
11.3 Loss of the stand location due to late payment does not release the Exhibitor from the payment obligation. The Organiser shall be entitled to collect the full amount due.
11.4 Any applicable taxes and charges will be invoiced where applicable.
Article 12 | Cancellation by the Exhibitor
12.1 Cancellation must be submitted to the Organiser in writing or by email.
12.2 In the event of cancellation of an already reserved stand, unit or market stall, the following cancellation charges apply:
- cancellation four weeks before the Event: 25% of the invoice amount relating to the reserved square metres;
- cancellation three weeks before the Event: 50% of the invoice amount relating to the reserved square metres;
- cancellation two weeks before the Event: 75% of the invoice amount relating to the reserved square metres;
- cancellation one week before the Event or later: 100% of the total invoice amount, including reserved facility services.
12.3 For the 25%, 50% and 75% cancellation percentages, facility services are not included in the calculation unless those services have already been ordered by the Organiser or costs have already been incurred.
12.4 Cancellation does not release the Exhibitor from the obligation to pay the amounts due under this Article.
Article 13 | Attendance and Use of the Stand
13.1 The Exhibitor must be present during all opening hours for Visitors and must keep the stand open and presentable.
13.2 The stand may not be fully or partially dismantled or cleared before the end of the applicable opening hours without permission from the Organiser.
13.3 The Exhibitor must follow instructions from the Organiser, Venue management, the fire service, security personnel and other competent authorities. This applies in particular to safety measures during the Event.
13.4 Only goods and services that fit the nature and concept of the Event may be offered at the Event, at the Organiser’s discretion.
13.5 The Exhibitor is responsible for checking with the Organiser in advance whether its intended products, services or activities are permitted.
Article 14 | Stand Setup, Advertising and Nuisance
14.1 The setup and use of the stand, the sale of goods and the provision of services must not cause nuisance, danger or disturbance to other attendees.
14.2 Without the Organiser’s prior permission, it is not permitted to display, place or distribute advertising, flyers, promotional materials or other commercial communications outside the Exhibitor’s own stand.
14.3 The use of amplified sound requires prior approval from the Organiser.
14.4 Any permission granted for amplified sound may be withdrawn at any time if, in the Organiser’s opinion, it causes nuisance or is used improperly.
14.5 Activities involving smoke, fire, unusual electrical loads or other potential safety risks are only permitted with the prior approval of the Organiser and/or Venue.
Article 15 | Stand, Venue and Materials
15.1 The Exhibitor is responsible for the safe and proper setup and use of its stand.
15.2 Escape routes, emergency exits, fire extinguishing equipment and other safety facilities must remain accessible at all times.
15.3 It is not permitted to damage floors, walls, ceilings or other parts of the Venue. This includes drilling, nailing, screwing, painting, wallpapering, gluing or other work that may cause permanent damage, unless prior permission has been granted.
15.4 Damage to the Venue, stands, market stalls, tarpaulins, clamps, materials or other items supplied by the Organiser or Venue will be charged to the Exhibitor where such damage can be attributed to the Exhibitor.
15.5 The Exhibitor must keep the stand clean and tidy throughout the Event.
15.6 After the Event, the stand must be completely cleared and left clean within the dismantling period specified by the Organiser.
15.7 Costs for cleaning, repairs, removal of abandoned goods or waste and other costs resulting from failure by the Exhibitor to comply with these obligations may be charged to the Exhibitor on the basis of actual costs incurred.
Article 16 | Electricity, Lighting and Stand Construction
16.1 Electricity is only available if a connection has been reserved in advance or if other arrangements have been made with the Organiser.
16.2 The Exhibitor is responsible for ensuring adequate and proper lighting of its own stand and for using safe and approved electrical equipment.
16.3 In the case of special stand construction, large structures or the use of trucks or other large vehicles for setup or dismantling, the Exhibitor must notify the Organiser in advance.
16.4 The Organiser may require the Exhibitor to provide advance information regarding, among other things, the height and dimensions of the stand and the dimensions and height of vehicles used for setup.
16.5 The Exhibitor must comply with the setup and dismantling times specified by the Organiser.
Article 17 | Sales and Alcohol
17.1 Where sales are permitted during the Event, the Exhibitor is solely responsible for complying with all applicable legal requirements relating to sales, consumer rights, product safety, taxes and payments.
17.2 The Organiser is not a party to agreements between Exhibitors and Visitors and shall not be liable for products or services offered or sold by Exhibitors.
17.3 Exhibitors are not permitted to sell alcoholic beverages from their stand unless prior express permission has been granted by the Organiser and the sale is fully compliant with applicable laws and regulations.
17.4 Any fines, damages or other costs resulting from a breach by the Exhibitor of applicable alcohol-related regulations shall be borne by the Exhibitor.
Article 18 | Liability and Insurance for Exhibitors
18.1 The Exhibitor participates at its own expense and risk and is responsible for obtaining appropriate insurance against, among other things, legal liability, damage, fire, loss and theft.
18.2 The Organiser shall not be liable for loss, theft of or damage to goods, stand materials, vehicles or other property belonging to the Exhibitor, unless liability cannot be excluded under mandatory law.
18.3 The Exhibitor shall be liable for damage caused by the Exhibitor, its employees, assistants, stand, materials, products, services or activities to the Organiser, the Venue or third parties.
18.4 The Exhibitor shall indemnify the Organiser, insofar as permitted by law, against claims from third parties arising from acts or omissions by the Exhibitor, its employees or assistants, or relating to its products, services, stand or activities.
GENERAL PROVISIONS
Article 19 | Photography, Video and Media
19.1 Photographs, video recordings and audio recordings may be made during the Event for journalistic, promotional, commercial and archival purposes relating to the Bigtwin Bikeshow & Expo and the Organiser’s activities.
19.2 Visitors may appear recognisably as part of general photographs or footage of the atmosphere at the Event. For targeted portraits or other uses for which consent is required under applicable law, the Organiser will comply with the relevant legal requirements.
19.3 Participants and Exhibitors understand that their motorcycles, stands, products and presentations form part of the Event and may therefore be photographed and filmed and may appear in editorial and promotional publications relating to the Event.
19.4 Professional or commercial photography, video recording or audio recording by third parties is only permitted with the Organiser’s permission.
Article 20 | Programme and Changes
20.1 The Organiser may change the programme, opening hours, layout, activities, participants, artists, presentations or other parts of the Event where circumstances require this.
20.2 Such changes do not automatically entitle Visitors, Participants or Exhibitors to a refund or compensation.
20.3 Where special circumstances make this necessary, the Organiser may impose additional requirements on Visitors, Participants and Exhibitors regarding admission, safety, health, layout or use of the Venue.
Article 21 | Rescheduling, Cancellation and Force Majeure
21.1 The Organiser reserves the right, due to special circumstances beyond its reasonable control, to change the scheduled dates of the Event, reschedule, interrupt or cancel the Event.
21.2 Such circumstances include, but are not limited to, government measures, fire, extreme weather conditions, failure of essential services, strikes, epidemics, pandemics, serious security risks, terrorism, war and other circumstances as a result of which the Event cannot reasonably or safely take place.
21.3 If the Event is rescheduled to another date, an agreement entered into with an Exhibitor or Participant shall in principle remain in force for the new date.
21.4 If the Event is permanently cancelled by the Organiser due to circumstances referred to in this Article, the participation agreement shall terminate.
21.5 In the event of permanent cancellation, stand rental already paid will be refunded or credited. The Organiser shall not be obliged to pay compensation exceeding the amount paid by the relevant Exhibitor, less any specific costs already incurred by the Organiser at the Exhibitor’s express request, insofar as such deduction is permitted by law.
21.6 If the Event is required to be cancelled as a result of government measures, the Exhibitor’s participation invoice will be credited in full.
21.7 In the event of rescheduling or cancellation, the Organiser shall not be liable for additional damage or costs incurred by Visitors, Participants or Exhibitors, such as travel, accommodation, transport, staffing, production or other consequential costs, insofar as such exclusion is permitted by law.
21.8 Admission tickets purchased by consumers remain subject to applicable mandatory consumer protection laws in the event of cancellation or rescheduling.
Article 22 | Intellectual Property
22.1 Names, logos, trademarks, designs, texts and other materials belonging to the Bigtwin Bikeshow & Expo may not be used for commercial purposes without the prior permission of the relevant rights holder.
22.2 Participants and Exhibitors remain responsible for materials they provide and declare that the use of those materials does not infringe the rights of third parties.
22.3 By providing photographs, texts, logos or other materials for publication in connection with the Event, the relevant Participant or Exhibitor grants the Organiser permission to use those materials for communication, promotion, reporting and archiving relating to the Event, unless otherwise agreed in writing.
Article 23 | Personal Data
23.1 The Organiser processes personal data in accordance with applicable privacy legislation.
23.2 Further information about the processing of personal data can be found in the Privacy Policy on bigtwinbikeshow.com.
Article 24 | Applicable Law
24.1 These Terms & Conditions and all agreements relating to the Bigtwin Bikeshow & Expo are governed by Dutch law.
24.2 Disputes shall be submitted to the competent court in the Netherlands, unless mandatory law provides for a different competent court.
Article 25 | Final Provisions
25.1 If any provision of these Terms & Conditions is found to be wholly or partially invalid or unenforceable, the remaining provisions shall remain in full force and effect.
25.2 In situations not covered by these Terms & Conditions, the Organiser shall make a decision taking into account reasonableness, applicable law and the interests of the parties involved.
